Definitions"Service Provider" refers to '10 Day Website'."Client" refers to the party purchasing the service."Services" refers to the website design services provided by the Service Provider."Agreement" refers to these terms and conditions and any other written agreements between the Service Provider and the Client.
Service Provision The Service Provider agrees to deliver Services to the Client in a timely and professional manner, with a completion timeframe of 10 days from the start date agreed upon.
Payment Terms Payment is due 40% at the start of the project and 60% after the project is completed. The Service Provider does not offer refunds once the Services have begun. Prices are stated in Australian Dollars and are inclusive of GST.
Design Revisions The Service fee includes up to three (3) revisions of the initial design. Additional revisions beyond this scope will incur extra costs, to be negotiated and agreed upon before the commencement of further work.
Intellectual Property Upon full payment, the Client will obtain ownership of the final website design and content. The Service Provider reserves the right to use any work for promotional and marketing purposes, subject to Client’s privacy rights and proprietary information rights.
Limitation of Liability The Service Provider shall not be liable to the Client or any third-party for damages, including lost profits, lost savings, or other incidental, consequential, or special damages arising out of the operation of or inability to operate the website, even if the Service Provider has been advised of the possibility of such damages.
Warranties The Service Provider does not provide warranties of any kind, expressed or implied, for any and all products and/or services that it supplies. The Service Provider will not be held responsible for any and all damages resulting from products and/or services it supplies.
Indemnity The Client agrees to indemnify and hold harmless the Service Provider from any and all claims, demands, losses, causes of action, damage, lawsuits, judgments, including attorneys’ fees and costs, arising out of or relating to the Services provided.
Governing Law These Terms and Conditions are governed by the laws of Australia and each party submits to the jurisdiction of the courts of Australia.
Acceptance of Terms By hiring the Service Provider for website services, the Client acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions.
